My Hearing for unfair dismissal was listed on 13/14/15 July 2011.Employment Tribunal cut off my claim under discrimination.
Hearing has not taken place.it has been postponed to the end of November 2011.I really doubt if it takes place at all.Past has learnt me that every time I am invited on prehearing review where they always cut off everything what i can proove without any doubts.
UNFAIR DISMISSAL-STATEMENT OF BEATA ULIKOWSKA
This is a statement of Beata Ulikowska . I was employed by Alibone Recycling Limited Moulton , Northants as a recycling operative in period from 4th August 2005 to 9th September 2008 .

In period of my employment I was a victim of criminal offences , I witnessed a danger to health & safety of mine and other employees and I was a victim of breaching of legal obligation by management of Alibone Recycling Ltd.

s order from 24 / 06 / 2008 saying , that the Claimantsshould disclose all documents in their possession that are relevant to the case no:
1200237/2008 and 1200238 / 2008 and send them to the Respondent by 22 / 07 / 2008 ,
I made as was directed .

To the Bundle I attached letter , which I sent to Ministry of Justice on 15th june 2008 .
This is content of this letter .
We are looking for persons or institutions who would like to help us . I and my boyfriend , we have been working in Alibone Recycling Ltd for almost 3 years . Company is situated in Moulton ,Northants . From the begining we have experienced horror : we are mentally and physically destroyed . In our factory work ( including us ) 10 Polish people and about 20 English . My boyfriend does not know English - I am only one woman ( besides office staff ) in all company and I believe that as a woman and as Marek ' s girlfriend I should not search for others men company . We are isolated and nobody really knows us . I tried to speak to our bosses about our difficult situation , that we are discriminated by other workers , that they torment our mentality . Result was always inverted - our bosses turned back to us . Stressful relationship and harmful work conditions caused that on 2nd January 2008 we raised Grievance Procedure on writing stage 1 . Our bosses became angry that we dared accuse this inhuman workplace and since that moment we experience the worst horror than ever . The organized group of Polish people and some English strongly suported ( and under their command ) by company ' s Management terrorize us . In our direction was sprayed paralizing gas , were frown different subjects : bottles , apples ,tins , hard patatos , balls , some of them hit me . I reported about those incidents to police . There was also specially created burglary to our cupboards in our canteen .We have got a lot of troubles in our private life , because our bosses have got influential acquaintances . We wrote letters to Northamptonshire County Council , Health and Safety Executive and police , everything in vain . We wanted ( and still want ) to go to court and found criminal case against our company . We asked police for help . Police officer , who came to our company on 13th June 2008 , said that he wants to help us , but it was only mistification . He acted in cooperation with our chiefs . That appointment was arranged ( what policeman admited ) with our bosses , but without our knowledge . We had no chance to prepare for this meeting . We could not present our documentation . Normally , when police is informed about crime ( violence at work ) , is carried over special procedure . They should take down the evidence , write down victims ' statements , but not to meet within company , where crime is commited and act commedy before us , our boss and his assistant , who made notes - what was additionally very stressful . We simply could not speak in our boss presence . It was next trial of intimidation . When we asked for next , planned in advance meeting in neutral place and without our boss , police officer cease appointment with comment , that he can not do anything else . That all conversation it was ordinary farce and it is not in conformity with criminal law in European Union . When police does not help victims and only helps criminals , there is only one answer , that police is involved into backing for family reasons and acquaintances . We do not know now , where we can ask for help yet , when in democratic country , which is United Kingdom , broken is law , so something is wrong . Do Alibone ' s Recycling Ltt . bosses , who treat themselfs as gods and criminal group go unpunished ? We believe that NO . a)Rubbish was kept for very long time - even 10 weeks . In November 2007 rubbish was delayed , vaporized , it looked like boiling water , because of smoke hovered above . Rubbish was hot in touch . I had to work with it and breath in toxic , hazardous to health substances . Pages :-26;97

b)Sam Hartwig and Tom Ragan smoked at work marihuana and after that operated vehicles , they worked on the line . Adam Kwiatkowski was few times at work drunk , the same Marcin Ciecierka , Marcin Grzes , Marcin Golab , Tom Ragan and Lukasz Ciecierka . 0n 11th February 2008 , burglary to our ( my and my boyfriend

f)On 18 th February 2008 , second belt , Marcin Grzes and I - small plastic position . Marcin Grzes sprayed paralyzing gas in my direction . I started to cough and chock .I reported it to police , no : 750 / 18 / 02 / 2008 .pages:-47;64;86;116-117

On 25th April 2008 someone poured perfume to our ( my and my boyfriend

i)On 25th April 2008 , during break , when was emptying skip with paper , next to my head flied ball , than decayed apple . Tom was only one person , who came out from place , where these subjects were thrown out . j)On 28th April 2008 - I was sweeping outside our warehouse , it was before 5 p.m. after work on line . Tom hit me with hard potato . I had got big bruise on my right leg . I called to police - 816 / 28 / 04 / 2008 - incident number , I went also to hospital .
The second hard potato flied next to my head , I saw Tom , as only one person in place from where this subject was thrown out . I spoke to Paul Gray about these incidents on 30th April 2008 . Pages:-44-45;47;50;51;64; staff book 82;83 and 84; 92-93;

l)On 2nd June 2008 , the rest of the team was putting in order pallets , I was waiting when they finish that I could start to sweep around . One tennis ball hit me on my back , few minutes later , the second ball flied next to my head - I reported to Doris Pietniczka - Panek and Ian Gray . m)During manual handling training - Colin White - person ,who lead this training said , that I am TOO SHORT to work on the line . That it is why I have got problems with my back . I said , that I am using pallet as an elevation platform , so I am not so short . He denied , he explained me ,that my hands are still too short and that I have to be all the time bent to reach opposite border of the belt . He said that he is surprised , that I am still working on the line , because he had already told about that to the management . They not only deliberately kept me working on the line , they also forbad me using pallet as a platform (Julia
s Leatherland decission from June 2008 ) .Since then my problems became bigger : - I felt terrible pain in my feet , I had to stand on my fingers , I had to put feet in different uncomfortable positions . My hand were too short I was always very hard pressed with my chest to the belts border . Between me and border was threshold , so my feet were farer from border than the rest of body . I was not able to find convenient position . My feet were always in deformed position . My legs hurt me . During day they became fatter , at nights I had got cramps .-
Hands - pain and growing stiff . When I could not use pallet was even worse . When I was taller I kept my hands lowered , than after Julias Leatherland decission I had to keep them rised up . Besides I was scrubbing with my arms rubbish . Earlier I could from height , take for example plastic out of rubbish and not even touch with my arms waste . n)On 15th July 2008 I wrote statement in which I described Tom Ragan using his mobile phone in operating area .( On 11th July they suspended my boyfriend for using mobile phone and on 23rd July they dismissed him. He took some pictures with his mobile to give evidence how I - his girlfriend - I am distroyed at work .) My words simply means nothing in this company . They had never really reacted on acts of violence where I was a victim .

On 30th April 2008 , someone stole from my cupboard 12 paper masks - I reported to Paul Gray on 30th April 2008 and Marcin Ciecierka .
On 22nd July someone poured water into my locker in canteen . I had to throw away some of my stuff , it was damaged by water . I told about that to Marcin Ciecierka . On 5th August someone was looking through my stuff in the same brown cupboard , next day I spotted that someone stole my brass tap . I told about it again to Marcin Ciecierka , on 8th August Jason and Doris invited me for meeting . They wanted to speak about theft

p)On 30th July 2008 , they made the most dangerous thing I have ever seen . They were working in shredder ( Tom Ragan , Marcin Dziuba , Marcin Golab , Lukasz Ciecierka ) , They put too much paper on belt and compactor
s chemney was blocked . They have to open the chimney , push paper , close the chemney . Normally it lasts very long , you have to repeat those activities many times . To avoid such boring task and make thing faster - Marcin Golab went to inside of chimney and unblocked it with his legs . r) I had got permanent headache caused by stress at work . I wrote about that in my sickness form , but nobody care about that , they founded me few the most stressful days as ever . They dismissed my boyfriend the only one person who I could rely on . I was living under terrible pressure . On 1st August 2008 I complain to Doris Pietniczka Panek about my health problems , as a result I obtained letter from her , where she scared me , that if I am too ill they dismiss me . u)In our warehouse only for short periods , there was full number of staff . Normally on the line should work 9 people and one additional outside as a digger operative . On 29th February 2008 ( he worked from Autumn 2007 ) Ryszard Jaworski left job . Since that moment nobody was hired . Additionally they started to take Sam Hartwig from our warehouse to work with Pit - lorry driver as his helper . Those days on the line was only 7 people and 1 in the digger . As a result almost everyday I had to stand alone on cardboard or on small plastic position . I am too short to work alone on cardboard .
On 30th July 2008 on the line was 5 people plus 1 person changing his role - from digger operative to rubbish position . Sam Hartwig was taken by Pit to go with him by lorry , Lukasz Circierka was taken by Max Gray ( our boss ) to help him in his private orhard .
During Ryszard Jaworski employment our absolutely record was 142 tonnes , but it
happened only once . Than , when we were not in full number of staff we were duing even over 170 tonnes ! It was creasy situation because pace was terrible fast and it had got nothing common with recycling , too much plastic , tins cardboard , clothes etc is left . There should be remaining only paper in its pure shape.After my grievance procedure I hoped that pace will be reduced.I was complaining about so many aspects connected with too hard job , but they seemed that they want to exhaust me even much more-physicaly and psychicaly.pages:26-27;103

w)Because of long terms of preserving rubbish , There were plagues of rats . They are very dangerous for health , especially their urine which can cause death . Their bite is also very dangerous.pages:-26;96;;97;98;

First time I asked for help in September 2005.I was speaking with foreman Glen. That and every next my trial in searching for help - including grievance procedure from January 2008-
did not bring any positive effects .My situation within company was becoming worse and worse.page 60

Suspention is kind of detriment.
They had no right ordering me for disciplinary hearing.
Word -disciplinary- it is detriment itself and demonstrates only advantage and power.

They again had got chance for repairing everything what they did wrong and they could cause by their improvement that I would write another letter describing good changes.
They could ,if everything what I wrote was not true and lowered of companys reputation make claim to the court under defamation.
They could if they were honest and if my letter really ofended them.I only named things like they were indeed.

In my statement I proved that my dismissal it was the next form of my harassment,bullying ,threatening ,victimization. I quoted above examples of what is considered by company Gross Misconduct.I was complaining on every mentioned by me example.Strangely every accused by me person is still working and there were not any investigations ,suspentions and dismissals.

During my employment I witnessed acts of damage to health and safety of individuals, crime offences like harassment ,violence at work and bullying . I witnessed also breaching of legal obligations by my employers. Sadly a main victim of those all crimes was my girlfriend Beata Joanna Ulikowska.. They finally didmissed her on 9th September 2008.

After 10hours of hard work , without rest and eating we had to go to police station(about 30 minutes on foot).We were back at home at about 20.30. We were complaining to bosses many times .We knew that rubbish provided for recycling should not consist of decayed food etc.Bosses knew which lorry brings rubbish from which area,street.It was enough to report problem to adequate institution and give names of streets. But bosses had never worried about our health and safety.There could pass even 6 weeks and nobody from bosses appeared on our yard.Paul Hartwig -our supervisor ,and Marcin Ciecierka could threaten us like they only wanted. Every effort,every complaint made by Beata to bosses caused that she was more and more victimized and I with her.Bosses did not want to know anything and than when it was to late to pretend that they knew nothing about all situation,they started bullying us to make us too scared to speak.pages -26-27;34-36;96-97;105

I participated in our 3 grievance meetings - 2 with Julia Beric and Trevor North and 1 with Julia Beric alone.
I experiensed and I was a victim the same like Beata of breaching by them of legal obligations. They did not react on any act of criminal offence ,on any act of breach to health & safety.They did not guarantee to us safe place at work.pages-26-27;28-36;40-41;46;105-111;115;131

In her statement she underlined very strongly- breaching of health and safety regulations at work.by others workers and employers.I know that she was afraid of witnessing of any accidents.She was depressed enough by all atmosphere at work,by others hostile attitude directed to her that ,she could not bear any additional terrible experiences including menace of life.Her requests to Health and Safety Manager -Julia Leatherland and Health and Safety Officer Doris Pietniczka-Panek for reducing those acts of ommission and negligence were met every time with scoffs.We experienced that during grievance procedure and during every next contact with them.I can confirm that Beata was harassed and bullied by these two persons.Her complaints about stress at work were directed to them.Every return to work sickness form was checked by Julia Leatherland and Doris Pietniczka-Panek.If they did not help her,if they did not protect her from the causes of her depression (Beata every time precisely pointed the reasons of her stress),so they harassed ,bullied and victimized her the same.pages; 38;44-45;50;51-52;56;57;85;86;90;104;119;122-123;

She was only one person , who worked for such a long time and she did have not got any license . In February 2007 I was teaching her how to operate fork lift truck . When earlier, during breaks , when skip with paper was changed , fork lift truck was standing useless , after that , when I started to teach Beata, everyone was in need to take truck and do anything with it . Fork lift truck appeared as a very needed instrument , so I could not instruct her any more,

We were shocked that letter were we described only true became excuse for dismissing her,especially that it was written after taking several trials to search for help within company, between bosses and health and safety representants.

Beata was destroyed emotionally and she could not attend any disciplinary meetings .She felt that they punished her in advance .All their action-trial of interrogation,suspention and letters calling for disciplinary hearing -were proof of it. Besides she had got experience: she was during my disciplinary hearing(page 118) and she was at grievance hearings.She knew company methods very well(page 33;46;105-1070

STATEMENT OF BEATA ULIKOWSKA
This is a statement of Beata Ulikowska . I was employed by Alibone Recycling Limited Moulton , Northants as a recycling operative in period from 4th August 2005 to 9th September 2008 .
1.
In period of my employment I experienced discrimination under my gender , harassment and discrimination via victimization .

Autumn 2005 - Marcin Ciecierka , Marcin Gwizdek and Maciej RoΏenek , they came to work at 7.00 a.m., because of overtime , I and my boyfriend at 7.30 , because nobody had never asked if we want to do overtime . After my intervention , we could come at 7.00 like others .

In spring / summer 2006 we had to walk on piles of rubbish .They were installing new sorting machine in top yard . Rubbish was thrown down onto ground , we had to walk on it and take out clothes , plastic sacks , glass , wood etc. It was period of terrible hot weather . We made it in burnt sun . Once I sat down for a moment because it was short break . Passed there Mark Gray and said , that if I have nothing to do I should go and clean office. Break was not because I stopped working , break was because others ceased work , but only I could not take any moment of rest.

In period March 2006 - September 2006 I and my boyfriend , we had to do the dirtiest and heaviest jobs in all company, when others English and Polish people ( Marcin Ciecierka , Maciej Rozenek , Marcin Gwizdek , since July Leon Miluszkiewicz ) had more pleasure jobs e.g. operating vehicles ,we had to clean compactors , clean bailing machines , sweeping around all premises .When rest of the team could rest for two hours in vehicles I was all day on foot . Compactors were not cleaned for longer time . It was very hard especially for me as a woman . I had to use rake , suffle for tidying . I worked with boxes and pallets .

In Summer 2006 - The rest of Polish employed at the moment people , went to Mareks Gray private garden to do for him some job . I remained in warehouse . My task was to pick big , very heavy boxes ( about 25 kilos each ) from about 15 th pallets and throw their contents onto belt to be bailed - my body weight is 46 kilos . I had to also collect empty wooden pallets from the ground and carry them in concrete place . They were very heavy . At the beginning I left them on the ground , that some man will collect them later, but Glen - Foreman , forbid me do that.

August 2006 - April 2008 , During work , they were going out , one after another for cigarette , when one was smoking , the rest of the team was working , I and my boyfriend, we are no smokers , so we had no breaks for cigarette like others , we had to work harder , because of smaller amount of workers on the line .

August 2006 - 13th February 2008 , I and my boyfriend ( he on 25th April 2007 started work in other yard ) , we had to tidy working position after other workers , They did not tidy their position after work , every next day we started from cleaning , it was very annoying , because we always left order after us.
Since 13th February mess is usually left by Tom Ragan and Sam Hartwig , and now I have to tidy after both of them . I complained to Paul Hartwig and Marcin Ciecierka .

ON 5th October 2006 , we obtained new schedule from Jason Gray . Maciej Rozenek was standing 5 days out of 7 with his best friend Marcin Ciecierka . Marcin Grzes was standing 5 days out of 7 with his best friend Lukasz Ciecierka . I and my boyfriend we were standing only 1 day out of 7 together.When we were standing together my boyfriend could help me,since that moment I could count only for myself.I lost physical and psychical support.

In 2006 I found gold ring . It was made of yellow and white gold incrusted with gemstones . I showed it to Paul Hartwig , he had got magnifying glass and wanted to see this ring through . I passed him my ring . He did not give me it back . He said , that he first it spotted , so ring belongs to him and this is why he stopped the belt . Belt was stopped by my boyfriend.

They promissed to pay for 2 sickness days a year . In 2006 bosses did not pay money from this title.Every sickness day which I took in this company was connected with my backbones pain-I had to rest .At one side they were forcing me to unhuman effort at the other they refused me ( without any antisipation )to pay for my sickness .Sickness caused
by work ,work in Alibone Recycling Ltd.

January 2007 - March 2007 - Paul Hartwig , Lukasz Ciecierka , Marcin Grzes , Adam Kwiatkowski , they were standing , smoking , talking etc. during breaks , when skip with paper was emptying , I and my boyfriend, we had to sweep around . It was Paul Hartwig , who established rule - people standing on first line sweep outside warehouse , people standing on second line sweep inside . In spite of this rule I and my boyfriend , we had to sweep everywhere , on 26th January 2007 - we decided not to sweep , when it was not our turn , but Paul Hartwig reacted very quickly , he bid us act like up to now.After each trial to make any complaint on existing,prejudicial to me and my boyfriend conducts -my situation became worse.

I was only one person , who worked for such a long time and I did have not got any license . In February 2007 my boyfriend was teaching me how to operate fork lift truck . When earlier , during breaks , when skip with paper was changed , fork lift truck was standing useless , after that , when I started to learn , everyone was in need to take truck and do anything with it . Fork lift truck appeared as a very needed instrument , so I could not continue lessons .

During my employment , many times I had to unload van . I was carrying very heavy , full of paper sacks and boxes . Those paccages were provided for shredding .
In Spring 2007 Ian Gray asked me to go with Maciej Rozenek by van . He twisted his ankle . I had to help him with loading van . We were collecting boxes and sacks from many companies .I think that it is no need to remind every time that I was only one woman (besides office staff) working in that company.There was about 40 men.By strange chance I was always chosen to the heaviest and dirtiest jobs.

I and my boyfriend we obtained Staff Handbook , after 2 years of work (13/08/2007).It is not OK that some of documents our bosses gave to us for signing in English , but the other one they had never shown because they were not translated into Polish .They deprived me of knowledge about my rights.This document was saying about protection against harassment and discrimination,was telling about punishing of every,single symptom of those acts,but unfortunately these watchwords were not reflected into reality.

In autumn 2007,bosses in spite of this , that they agreed to pay for us bonuses,when we do more than 90 tones a week ( 1 pound per each ton from 90 to 100 and 2 pounds per each ton over 100 ) , they did not supply us with rubbish . Pace was not lowered . We did 90 tons in 4 days , and the 5th day we had to look after other duties on another yard.They did not lower pace,because they wanted to have got the 5th day as a more leisure one.They could spent that all day in vehicles.It was only me who had to lift heavy boxes.

Rubbish is kept for very long time - even 10 weeks . In November 2007 rubbish was delayed , vaporized , it looked like boiling water , because of smoke hovered above . Rubbish was hot in tuch . I had to work with it and breath in toxic , hazardous to health substances .

When someone is driving lorry they stand on lorrys stairs and cover lorrys mirror . In 2007 Leon Miluszkiewicz strucked against fork lift truck , when he was reversing , because he could not see anything behind someones head , who was standing on lorrys stairs .He could run over me or another person.I told about that to Paul Hartwig but it did not bring any result.

Rubbish was kept outside . This wass terrible in winter and after rain . In winter it iwas covered with hoar - frost , my fingers were numb with cold . They hurt with every tuch and I in spite of this had to work . After rain my gloves became slippy . After our grievance company started to provide one pairs of gloves a week , earlier I had to work even 7 weeks with the same gloves . Once I asked Paul Hartwig for new pairs , I wanted to have them for later , he refused me . In the same week he gave 3 pairs to Marcin Ciecierka because he often did not know , where he put them . So , when my gloves became damaged Paul Hartwig did not have any to give me . I had to work next 2 weeks in torn gloves .

I had never agreed to work as a piece worker . It is difficult for me as a woman to work amongst men and keep pace with them , at their fast rate , do the same quantity and carry the same burdens . Even the best sportswomen in the world have other than men regulations .

According to law in England is 48 working hours limit a week including overtime. Normally people work 37 , 5 basic hours plus overtime . We worked much longer within the limits of basic hours.I had to work longer to earn the same money which I could earn doing less hours if they paid correctly.

Sam Hartwig and Tom Ragan smoke at work marihuana and after that operate vehicles , they work on the line . Adam Kwiatkowski was few times at work drunk , the same Marcin Ciecierka , Marcin Grzes , Marcin Golab , Tom Ragan and Lukasz Ciecierka . They operated vehicles and worked on the line under influence of alcohol.

They were smoking cigarettes ( during work and not in predicted for that reason place ) , They hid behind compactors , toilets , and behind warehouse .

Because of long terms of preserving rubbish , There were plagues of rats . They are very dangerous for health , especially their urine which can cause death . Their bite is also very dangerous.

It lasted over a year ,when I was asking for changing bulbs above MRF line .

For over 2 years company was not supplying us with protective paper masks .

During Grievance Procedure hearings with Julia Leatherland and Trevor North , I and my boyfriend we met with very strong discrimination - especially from Julia .During hearing(24/01/2008) I was complaining about discrimination,harassment,bullying,health and safety conditions at work,my health problems caused by work and unhuman physical effort to which I was forced by employers and other employees.My complaints were disregarded and since that moment they started to victimize me with bigger strength and power.

In our company new regulations have come in law after that ,when we , I and my boyfriend do something . On 8th January 2008 we took day off , next step of Julia Leather land -Health and Safety Manager , was to ask us for filling self certificate absence form and return to work review , rest of the workers were informed about such duty on 21st January 2008 . On 25th May 2008 Julia Leatherland showed me the door and said , that from that moment I can not come to bosses office . The rest of workers about new rules in contacting with management was informed in July 2008 . On 7th July 2008 during break I left our factory , I had to go to post office . I did like that many times before . I was buying food for lunch in nearest shop . This time it was problem . Doris Pietniczka - Panek and Jason Gray informed me that each time I must ask my supervisor for permission and use my clock card ,every time , when I leave company . The rest of staff was informed on 17th July 2008 . It was made to take more control above my and my boyfriends life.

In January 2008 , First line , Sam Hartwig cardboard position - I rubbish .Sam found a dead rat and he cut it with knife into small pieces . He did it on belts border , machine was all the time operating . I am sensitive person , it was for me terrible experience . I commented it in our canteen . Marcin Ciecierka was also present .

In January 2008 , I was working on second line , on magnet position , after third break - to the bars ,which are around the magnet , was tied up a rat with wire .Everyone knows that I am afraid of rats and abhor them. I can not even look at them . At the beginning I did not see it , because it was hidden under the magnet . I saw it when machine started to work and belt started moving . I was frightened because rat looked like alive , it was moving together with line and finally stopped before my person , kept by wire . I had to untie it before I could start to work .

January 2008 - May 2008 , Marcin Grzes , Marcin Golab and Lukasz Ciecierka , they pissed in front of me .

January 2008 - May 2008 , Marcin Golab , Marcin Grzes and Lukasz Ciecierka ( about Tom Ragan I wrote in paragraph 68,78,79) they used wrong language , I had real basics to take those words as words concerning my person.I can quote one example:in my grievance procedure I was complaining about my backbones pain .Marcin Grze said in canteen to £ukasz Ciecierka: if you had to carry every day such buckets (in Polish colloquial and not nice about big breast) in front of you, you would saffer from backbones pain too.I have got my breast far longer before my employment in Alibone Recycling Ltd and I had never suffered from such pain before.It is very soft example. Mostly there were designations: bitch,whore,count etc.Once Tom said to me in Polish - zrσb mi loda-what means-suck my dick.

They were looking for possibilities of dismissing me and my boyfriend . Our work agreements from 5th February 2008 , were the first step of it . We were very good workers, so they could only provoke situations , which could lead to disciplinary dismissal . They tried to sack my boyfriend-only one friendly to me person- in March , But he had got very strong argumentation and he kept his position , but in July they achieved success .I think that there is not necessity to explain how stressful it was period for me and my boyfriend.I had to watch for every my move whilst others could do anything whatever they wanted including harassment with impunity

0n 11th February 2008 , burglary to our ( my and my boyfriends ) cupboards in our canteen . All our stuff was on the floor . One lock was damaged . To this cupboard they did no have spare key . I asked Marcin Ciecierka - why there is no police ? He as a response shook only his shoulders.

On 18 th February 2008 , second belt , Marcin Grzes and I - small plastic position . Marcin Grzes sprayed paralyzing gas in my direction . I started to cough and chock .I reported it to police , no : 750 / 18 / 02 / 2008 .

On 26th February 2008 , very strong hit on my back with big piece of cardboard . I stood on big plastic.I agree that I can not point at an individual who did it. Instead I can point at Alibone Recycling Ltd as the place where such things could happen .Every company MUST provide safe, free from violence,discrimination,victimization and harassment workplace.

In our warehouse only for short periods , there was full number of staff . Normally on the line should work 9 people and one additional outside as a digger operative . On 29th February 2008 ( he worked from Autumn 2007 ) Ryszard Jaworski left job . Since that moment nobody was hired . Additionally they started to take Sam Hartwig from our warehouse to work with Pit - lorry driver as his helper . Those days on the line was only 7 people and 1 in the digger . As a result almost everyday I had to stand alone on cardboard or on small plastic position . I am too short to work alone on cardboard .
On 30th July 2008 on the line was 5 people plus 1 person changing his role - from digger operative to rubbish position . Sam Hartwig was taken by Pit to go with him by lorry , Lukasz Circierka was taken by Max Gray ( our boss ) to help him in his private orhard .
During Ryszard Jaworski employment our absolutely record was 142 tonnes , but it
happened only once . Than , when we were not in full number of staff we were duing even over 170 tonnes ! It was creasy situation because pace was terrible fast and it had got nothing common with recycling , too much plastic , tins cardboard , clothes etc is left . There should be remaining only paper in its pure shape.After my grievance procedure I hoped that pace will be reduced.I was complaining about so many aspects connected with too hard job , but they seemed that they want to exhaust me even much more-physicaly and psychicaly.

In February 2008 someone hit me with plastic bottle on my hand .I was on second belt , small plastic position , opposite me - on big plastic , stood only Lukasz Ciecierka .

Tom Ragan and Sam Hartwig they almost did not work during breaks ,when skips were emptied. As a result I had got more work to do . They were usually spending breaks in toilets , behind compactors or just sitting . About Tom , that he was not working on the line I wrote in paragraphs : 40,48,66. Sam during hours of work was more occupied with magazines than with job .In period February 2008 - 3rd April 2008 - Sam Hartwig was spending on the average on every day 130 minutes in toilet plus legal breaks and plus breaks for changing skips , his working day was shorter than my about 4 hours .

On 3rd March 2008 , second belt , small plastic position , during short break , when was nothing on the belt , but machine was operating , Lukasz Ciecierka asked Sam Hartwig to come down to him on the ground , after several seconds I saw , on the belt before me bloody rat ( Sams speciality ) .

On 17th March 2008 , Tom and I , we were working on second line , big plastic position .
Tom stood as a first person , before me . He did not work , he did nothing . There was a lot of work to do . I was terrible tired , because I had to work as two people in one person. Tom started to read newspaper . I threw on the belt , next to him few plastic bottles , to make him work . I made it twice . He did not react , too occupied himself in magazines . The third time - one out of bottles ( it was not my intention ) hit him . He was very angry . He started shout : What ! What ! . He took several bottles and with all his power threw them into my person . I have to explain working rules on the line . Each person is responsible for particular task . People whose stand on rubbish position have to take out of all rubbish : plastic bags , clothes , wood , glass , food ,next position is cardboard . People standing there are responsobile for taking out cardboard . Next positions are on second belt . There is small plastic , big plastic and magnet . First position on small plastic and big plastic is occupied by people responsobile for taking out only plastic bottles . They should also throw away cardboard and rubbish not taken out by people from first line . Second position on big and small plastic - there are people who take out everything made of plastic , but also bottles ,cardboard , rubbish left by people standing on earlier positions . Person , who stands on magnet ,has to take out tins , but also everything from plastic to rubbish -left by predecessors . If one person does not work , next one and others has got much more job to do .

On 27th March 2008 Marcin Dziuba found on belt blank cartridge . He started to play with it . Cartridge exploded and Marcin had got his head in blood .

On 1st April 2008 , I and Tom , we were working on second line . I worked on small plastic position , Tom stood opposite me - on big plastic position . He took out of rubbish tins , clothes , wood , glass , etc . and cast it on my belt , directly into my person , hitting me many times .I had to add , that Tom hardly ever takes out anything else than plastic bottles ,if he takes them at all .

On 1st April 2008 - I was working 2nd belt , small plastic position . At 14.58 came to me Marcin Go³Ήb and said , that he was chosen by everyone as Health and Safety representative and that he is responsible for contacts with H&S Manager and that he has meeting in few minutes . He also asked if I have got any queries . I was very surprised because I did not choose anybody and I did not know anything about this subject . I said that at that moment ( I was working , machine was operating I could say nothing , there was no time for thinking )

On 15th April 2008 - Tom hit me twice , first time on my back , the second time on my head . He used tennis balls to do it . I put down it into Accident Book .I was speaking about these incidents with Jason Gray - one out of my bosses .

On 17th April 2008 , I and my boyfriend we were working in shredder , someone put dead mouse on the ground . Someone hit with stone into shredders door , I was frightened with noise . They switched off compactor ( 4 times ) and ceased to us our work .The same situation was repeaten second time after two months ( someone was hitting with stone in shredders door ) - I said about this to Marcin Ciecierka

On 25th April 2008 someone poured perfume to our ( my and my boyfriends ) tea cups . We had not got washing up liquid , all day we drunk tea with perfume smell - I reported to Paul Gray .

On 25th April 2008 , second line , big plastic position , before me stood Tom . He again was not working . He turned back to belt , he leant on it , he read newspaper . I had to stop the line . I asked him for swapping positions , I heard only : Fuck you , Fuck off , so I said aloud to everyone , that we have to wait until Tom finishes to read magazine .
Tom changed working places with me at that moment , so I could again do work prepared for a one person , not for two people .

On 25th April 2008 , during break , when was emptying skip with paper , next to my head flied ball , than decayed apple . Tom was only one person , who came out from place , where these subjects were thrown out . I told about this to Paul Gray - my next boss - on 30th April 2008 .

On 28th April 2008 - I was sweeping outside our warehouse , it was before 5 p.m. after work on line . Tom hit me with hard potato . I had got big bruise on my right leg . I called to police - 816 / 28 / 04 / 2008 - incident number , I went also to hospital .
The second hard potato flied next to my head , I saw Tom , as only one person in place from where this subject was thrown out . I spoke to Paul Gray about these incidents on 30th April 2008 .

On 30th April 2008 , someone stole from my cupboard 12 paper masks - I reported to Paul Gray on 30th April 2008 and Marcin Ciecierka . Next day I had to work for over 1 hour without protective mask , our supervisor did not have spare one

On 1st May 2008 , during lunch break Tom took my pallets , without my knowledge and permission and threw them out from platforms onto the ground . I am short person I was using those pallets as an elevating surface . I reported to : Marcin Ciecierka - my supervisor, Paul Hartwig - my line manager and Mark Gray - my boss .

On 1st May 2008 , first line , From the beginning it was very hard day for me . I occupied alone cardboard position - position normally provided for two people . Before me on rubbish position stood Marcin Golab and Lukasz Ciecierka , they forced very fast rate . They did not stop belt , even when on the belt were huge piles of rubbish , higher then me, it was impossible to take cardboard from the bottom of such pile . I could not keep pace , additionally on the second line , big plastic position was occupied by Tom Ragan and Marcin Grzes , They started to throw away even the smallest pieces of cardboard (what normally is not practicable ) on the ground , to make me nervous that I am not good enough . After break Sam Hartwig and Adam Kwiatkowski were continuing this procedure .It was answer on complited by me day earlier sickness and return to work forms.I was writing about my stress ,permanent headache -everything caused by situation at work , by harassment and violence which I had to experience on every day.H&S Manager-Julia Leatherland was not even speaking with me .Nobody from management helped me.There were only further and more aggressive acts of bullying.

On 2nd May 2008 , Tom Ragan was operating digger ( without license ) , he omitted my face only few centimeters with diggers spoon . He was doing deliberately manoeuvres very close to my person .

On 6th May 2008 when I was going ( at the beginning of break ) to my boyfriend , to take him for break , someone hit very hard with big ball just above my head on shredders chimney. I was scared of noise and power of hit.

On 16th May 2008 , Tom again tried to hit me with bottles . It omitted my head only centimeters . I reported to police No :240 / 16 / 05 / 2008 .

On 29th May 2008 , we were sweeping around and under machine . I bent to rise up something from the ground , Tom deliberately swept rubbish onto my hand . I told about it to Doris Pietniczka - Panek - Health and Safety and HR Officer - on 2nd June 2008

On 2nd June 2008 , the rest of the team was putting in order pallets , I was waiting when they finish that I could start to sweep around . One tennis ball hit me on my back , few minutes later , the second ball flied next to my head - I reported to Doris Pietniczka - Panek and Ian Gray . I put down into Accident book .

On 9th June 2008 I was standing alone on cardboard position . Rubbish positions were occupied by Adam Kwiatkowski and Lukasz Ciecierka . Since the morning there was rats invasion . After several weeks we at last started to reach the wall - we were sorting rubbish which were brought to our yard in the beginning of March 2008 , when our compactor was damaged and its reparation lasted all week . Our production was then transient but rubbish was all the time carried into our workplace . It was usually 5 lorries a day besides Mondays . It was reason why we systematically had problems with rats - too long waste was kept in the yard . I was very scared for all day . Gays were pretending that care about my person and they killed some of rats . But once I rapidly raised my head . Lukasz Ciecierka was standing on belts border and showed to Adam Kwiatkowski how he pisses on me .

On 11th June 2008 , second belt ,magnet position . Tom was standing on small plastic. Tom stopped the belt , started to shout , that I leave to much rubbish , than came to me and show dried grass .I was very good worker , and I always worked very well . It was done to make me stressed .

On 18th June 2008 , first line , I and Tom we were working opposite each other on rubbish position . Tom found dead rat and cast it in my direction . It fell down just before me . He repeated this action , he threw this rat again , when it was , because of moving belt , farer of me . I told about this to Doris Pietniczka - Panek on 26th June 2008 .

On 19th June 2008 - second line , big plastic position , Tom stood before me . He again was not working . He sat on belts border ( machine was all the time operating ) than he sat on plain between belts he put his legs on belts border and sometimes he picked up plastic bottle from the belt under his knees .All situation was seen by Marcin Go³Ήb , person responsible for contacts with Health and Safety Manager and Officer . Tom then stood back by the belt and read magazine , as usual I had to work instead of two people .

On 19th June 2008 Second line , I small plastic position , Tom - magnet . I felt strong hit on my fingers Tom threw along the belt hard , big roll of fiscal paper . It was painful . Few minutes later , I was tidying my work position , I was collecting rubbish from platform , Tom passed next to me from magnet position . He did not say excuse me he just passed ,that his trousers scrubbed my face .I had got feeling of humiliation.

On 20th June 2008 , The second line , I small plastic position , Tom magnet , during 5 minutes break , Tom went out and shouted , that I leave too much plastic .
The same day I and Tom , both of us big plastic position . Tom stood before me . Again he was not working , during break I said to Marcin Ciecierka that I fed up with working as both people in one person . Tom shouted to me : shut up , fuck you , fuck off . I asked for isolating Tom from my person during work on MRF line . Marcin said that it is impossible After work , when Tom was leaving canteen , he said : fucking bitch , kurwa , kurwa . He knows some Polish swears , it means - whore , whore .

On 23rd June 2008 , I wanted to work in shredder . There had already been Tom and Sam . Tom closed door before my face and said , that they work only in both of them . It was nothing to do else , our machine was not operating , so I decided to stay and work with them . Tom was angry , he went to Marcin Ciecierka and complained that I do not want to leave them alone . Marcin came and bid me to leave shredder , he forbad me work with them. I felt very discriminated - the day before I asked him for isolating Tom and I had got real reasons , Marcin said no this day he said yes , he added also that in shredder should be only two people during work . I reminded him that on 10th June 2008 , they were working in 8 people in shredder - everyone but not me . In this situation I renewed my request for isolating Tom .

On 25th June 2008 , Tom was on first line , cardboard position , I was on second line big plastic position .They stopped line , Tom was killing a rat . I saw how he bent over banister of first platform . He kept rat for its toil in his hand and started to rock this rat , like before long cast . At that moment I saw this rat ( it was still alive ) before me on the belt . Tom threw it on my belt .
This day I and Tom , we were staying on second belt - big plastic position , Tom made spiteful faces to me , mocked me , mimicked .
He found plastic bag full of socks , he threw them out of bag to make I had a lot of work .

In June 2008 , our bosses promised us to pay bonuses for us in daily settling, not weekly, when we work not all week long because of bank holiday or damaged machine . They have not kept this promise.

In June 2008 they did not pay me for bonus for full attendance . I took one day sick , because of Tom Ragan behaviour , he hit me with hard potato - on 28 April 2008 , next day I was too sick to go to work . In such situation they should take responsibility for all incident. This simple example shows how I was treated . I was punished ,they did not pay me my hard earned money, and Tom could further with impunity torment me.

During manual handling training - Colin White - person ,who lead this training said , that I am TOO SHORT to work on the line . That it is why I have got problems with my back . I said , that I am using pallet as an elevation platform , so I am not so short . He denied , he explained me ,that my hands are still too short and that I have to be all the time bent to reach opposite border of the belt . He said that he is surprised , that I am still working on the line , because he had already told about that to the management . They not only deliberately kept me working on the line , they also forbad me using pallet as a platform (Julias Leatherland decission from June 2008 ) .Since then my problems became bigger : - I felt terrible pain in my feet , I had to stand on my fingers , I had to put feet in different uncomfortable positions . My hand were too short I was always very hard pressed with my chest to the belts border . Between me and border was threshold , so my feet were farer from border than the rest of body . I was not able to find convenient position . My feet were always in deformed position . My legs hurt me . During day they became fatter , at nights I had got cramps .
- Hands - pain and growing stiff . When I could not use pallet was even worse . When I was taller I kept my hands lowered , than after Julias Leatherland decission I had to keep them rised up . Besides I was scrubbing with my arms rubbish . Earlier I could from height , take for example plastic out of rubbish and not even touch with my arms waste . Now my shoulders were much lower so my hands ( From shoulders to fingers ) were all dipped in rubbish .

On 4th July 2008 , during break , they were emptying skip with paper , I was sitting next to stairs leading to the second platform , Tom was passing , he kept hammer in his hand . Immediately I raised up my head , I saw like Tom pretended hitting me with this hammer . He went on stairs and exactly above my head he hit into banister .

My person is constantly disregarded . I asked for explanation on writing for Marcin Ciecierkas decision . I asked for isolating Tom from my person , I had never obtained such explanation .
On 15th July 2008 I wrote statement in which I described Tom Ragan using his mobile phone in operating area .( On 11th July they suspended my boyfriend for using mobile phone and on 23rd July they dismissed him. He took some pictures with his mobile to give evidence how I - his girlfriend - I am distroyed at work .) My words simply means nothing in this company . They had never really reacted on acts of violence where I was a victim .
They did not care about my health .
On 30th July 2008 I told Doris Pietniczka panek and Paul Hartwig about dangerous behaviour of Marcin Golab , Lukasz Ciecierka and Marcin Dziuba . First of them was inside compactors chemney ,when machine was operating ( wider about this event in paragraph 84 ) . On 18th July 2008 I was sweeping yard , the rest of team went somewhere . After half of hour came Marcin Grze ,got on digger , and read newspaper and was watching me as I work . He did not help me , he all the time was sitting in digger . After longer time he said, that I can rest . At that moment I felt like his private servant

On 22nd July someone poured water into my cupboard in canteen . I had to throw away some of my stuff , it was damaged by water . I told about that to Marcin Ciecierka . On 5th August someone was looking through my stuff in the same brown cupboard , next day I spotted that someone stole my brass tap . I told about it again to Marcin Ciecierka , on 8th August Jason and Doris invited me for meeting . They wanted to speak about theft . As usual I was guilty , since that day I had to report after work about my findings on picking line . On 14th August 2008 , someone put into my bag ( which I was keeping in cupboard) empty yogurt . Since that day I am only one person who has to keep keys with me all the time .

Since 23rd July 2008 , when they dismissed my boyfriend I had no place in our canteen . I had got chair , which I was occupied during breaks since our canteen was given to us for using . Now this place is taken from me by Tom and Sam .

They have to open the chimney , push paper , close the chemney . Normally it lasts very long , you have to repeat those activities many times . To avoid such boring task and make thing faster - Marcin Golab went to inside of chimney and unblocked it with his legs . Compactor was operating at that moment .Only slight slip and person in chimney would be dead.

On 1st August 2008 we were sweeping outside warehouse next to compactors . Tom Ragan hit with his sweeping brush- glass bottle . It crashed and piece of glass hit Marcin Dziuba in his eye.
